Terms & Conditions

These Terms & Conditions (“Terms”) govern your purchase of products (including Foam Rollers, Fitness Watches, and Smart Scales) and use of services from our fitness product store (the “Store”), with a physical location at 78 Gateway Road, Roseburg Oregon, United States. By placing an order, creating an account, or interacting with our Store (online or offline), you (“Customer”) acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, please refrain from purchasing our products or using our services.

1. Order Placement & Acceptance

1.1 Order Submission

When you submit an order (via our website, email at allyciaroberts939@gmail.com, or in-person), you make a binding offer to purchase the selected products (e.g., 18-inch Medium-Density Foam Roller, Fitness Watch Pro, Smart Scale Essential) at the listed price, plus applicable shipping fees (per our Shipping Policy) and taxes. You confirm that all information provided (shipping address, payment details, product preferences) is accurate and complete.

1.2 Order Acceptance

We reserve the right to accept or reject any order at our discretion. Order acceptance is confirmed only when we send a shipping confirmation email (containing a tracking link, as outlined in our Shipping Policy) to your registered email address. If we reject your order (e.g., due to stock unavailability, pricing errors, or suspected fraudulent activity), we will notify you via email within 2 business days and issue a full refund for any payments already processed.

1.3 Pricing & Availability

  • All product prices are displayed in U.S. Dollars (USD) and include applicable state and local taxes, unless stated otherwise. We may adjust prices at any time, but confirmed orders will be fulfilled at the price listed at the time of purchase.
  • Product availability is indicated on our website. If a product becomes unavailable after your order is confirmed (e.g., due to unexpected stock shortages), we will notify you via email and offer two options: (1) a full refund of the order amount, or (2) a replacement product of equal or greater value (with your written consent).

2. Payment Terms

2.1 Accepted Payment Methods

We accept the following payment methods for all orders: Visa, Mastercard, American Express, Discover, PayPal, and Apple Pay. All payments are processed through PCI DSS-compliant payment gateways to protect the security of your financial information (see our Privacy Policy for details on data encryption and protection).

2.2 Payment Authorization

By providing your payment details, you authorize us to charge the full order amount (product cost + shipping fees + taxes) to your selected payment method. If payment is declined (e.g., insufficient funds, expired card, or fraud alerts), we will notify you via email to update your payment information. Failure to provide valid payment details within 5 business days will result in order cancellation.

2.3 Refunds & Payment Disputes

Refunds will be issued to the original payment method in accordance with our Return & Exchange Policy. We are not responsible for any bank fees, currency conversion charges, or delays in refund processing caused by your financial institution. If you dispute a payment with your bank or credit card issuer (without first contacting us to resolve the issue), we reserve the right to charge a $25 administrative fee to cover dispute-related costs.

3. Product Use & Liability

3.1 Intended Use of Products

Our products are designed for personal, non-commercial fitness and wellness use only:
  • Foam Rollers: Intended for myofascial release and muscle recovery. Do not use for weight-bearing activities (e.g., standing, jumping) or as a substitute for medical equipment.
  • Fitness Watches: Intended for tracking general fitness metrics (steps, heart rate, sleep duration). They are not medical devices, and heart rate/sleep data should not be used to diagnose or treat medical conditions.
  • Smart Scales: Intended for measuring weight, body fat percentage, and related fitness metrics. Results are for general fitness tracking, not medical diagnosis or treatment.
You agree to use all products in accordance with the included user manuals and safety guidelines. Misuse (e.g., submerging a non-waterproof Fitness Watch, using a Foam Roller as a chair) may result in product damage or personal injury.

3.2 Liability Limitations

  • We are not liable for any personal injury, property damage, or loss resulting from: (1) improper use of products, (2) failure to follow user manuals or safety guidelines, (3) pre-existing medical conditions, or (4) third-party modifications to products. Before using any fitness product, consult a healthcare provider if you have chronic injuries, heart conditions, or other health concerns.
  • Our products are sold “as-is” with no implied warranties of merchantability or fitness for a particular purpose, beyond their stated specifications. We do not guarantee that Fitness Watches or Smart Scales will sync with all devices or apps (see product pages for compatibility details). Our liability for product defects is limited to replacing the defective product or issuing a refund (per our Warranty Policy).

4. Intellectual Property

4.1 Store Intellectual Property

All intellectual property related to the Store—including website design, logos, product names (e.g., “Pro Series Foam Roller”), images, user manuals, and promotional content—is owned by us or our licensors. You may not reproduce, distribute, modify, copy, or use this intellectual property for commercial purposes without our prior written consent.

4.2 Third-Party Intellectual Property

Fitness Watches and Smart Scales may include third-party software (e.g., companion app frameworks, sensor technology) or trademarks. Use of this software is subject to the third party’s end-user license agreement (EULA), which will be provided with the product or via a link in the user manual. We are not responsible for third-party software updates, bugs, or compatibility issues.

5. Account Responsibilities (For Online Orders)

If you create an account on our website to track orders, save payment details, or store fitness preferences:
  • You are responsible for maintaining the confidentiality of your account credentials (username, password) and for all activities conducted under your account.
  • Notify us immediately via email at allyciaroberts939@gmail.com if you suspect unauthorized access to your account. We will assist with resetting your password and investigating the issue.
  • We reserve the right to suspend or terminate accounts for: (1) fraudulent activity, (2) violation of these Terms, (3) inactivity for 12+ consecutive months, or (4) misuse of account features (e.g., creating multiple accounts to exploit discounts).

6. Shipping & Delivery (Incorporation of Shipping Policy)

All orders are subject to our Shipping Policy, which covers delivery destinations (including APO/FPO addresses and U.S. territories), shipping costs, delivery timelines, packaging standards, and handling of shipping issues (e.g., delayed packages, damaged items). By placing an order, you acknowledge that you have read and understood our Shipping Policy.
Risk of loss or damage to products passes to you upon delivery (as confirmed by courier tracking or signature). We are not liable for delays caused by factors beyond our control, including weather events, courier strikes, customs hold-ups (for U.S. territories), or incorrect shipping addresses provided by you.

7. Termination

We may terminate or suspend your access to our Store (online or in-person), cancel your order, or refuse future purchases if you: (1) violate these Terms, (2) engage in fraudulent or deceptive practices, (3) harass our staff or other customers, or (4) fail to pay for orders. Termination will not affect any rights or obligations incurred prior to termination (e.g., payment for already shipped products, return obligations under our Return & Exchange Policy).

8. Governing Law & Dispute Resolution

8.1 Governing Law

These Terms are governed by the laws of the State of Oregon, United States, without regard to its conflict of law principles.

8.2 Dispute Resolution

  • Informal Resolution: Before initiating legal action, please contact us at allyciaroberts939@gmail.com to resolve disputes informally. We will respond to your inquiry within 10 business days and work in good faith to find a mutually acceptable solution (e.g., replacing a defective Smart Scale, adjusting a billing error).
  • Formal Disputes: If informal resolution fails, any disputes will be resolved through binding arbitration in Roseburg, Oregon, conducted under the rules of the American Arbitration Association (AAA). Arbitration awards are final and enforceable in any court of competent jurisdiction. You waive the right to a jury trial or class action lawsuit against us.

9. Amendments to Terms

We may update these Terms from time to time to reflect changes in laws, business practices, or product offerings. Updated Terms will be posted on our website with a “Last Updated” date. Your continued use of our Store or purchase of products after this date constitutes acceptance of the revised Terms. We recommend reviewing these Terms periodically.
